General Terms and Conditions Auctions - Conclusion of contract with Wepper-Auctions (Wepper Handels & Vermietungs GmbH)

The following general terms and conditions apply to all contracts concluded between us as the seller of the goods offered and an entrepreneur or consumer as the buyer (hereinafter referred to as “contractual partner”) in the version valid at the time the contract is concluded. Any conflicting terms and conditions of the contractual partner will not be recognized.



Conclusion of a contract
2.1. The presentation of the goods to be auctioned on the website does not constitute a legally binding contractual offer, but is only a non-binding invitation to the contractual partner to take part in the auction. If the contract is concluded, the contract is concluded with Wepper Handels & Vermietungs GmbH, Ober Sankt Georgen 40/2, Austria.

2.2. The contractual partner submits a binding contractual offer by registering on the website or creating a customer account and then successfully completing the provided procedure:

For fixed-price items, the buyer submits an offer by clicking the “Buy Now” button and then confirming it.

For fixed-price items for which we have preselected the “immediate payment” option, the buyer accepts the offer by clicking the “Buy Now” button and completing the immediately subsequent payment process.

At auctions, the buyer submits a binding offer to conclude a purchase contract by submitting a bid. A bid will expire if another buyer submits a higher bid during the offer period. The highest bidder will be awarded the contract at the end of the bidding period.

Before submitting a binding bid, the buyer can return to the website on which the contractual partner's information is recorded and correct input errors by pressing the "back button" contained in the Internet browser he is using or by closing the Internet browser Cancel process.

2.3. We confirm receipt of the bid immediately by an automatically generated email (“confirmation of receipt”).

2.4. After receipt of the bid, we will send you a confirmation and our terms and conditions by email. You can view the terms and conditions at any time at www.wepper-auctions.com. You can view your order details at any time in your user account.

2.5. The purchase contract is concluded when an order confirmation is sent, but at the latest when the ordered goods are sent.



Prices and payment
3.1. The prices stated are net plus sales tax, shipping fees, processing fees and any commissions.

3.2. The contractual partner has the following payment options: [cash payment, bank transfer].



Delivery
4.1. The ordered goods are delivered by providing and collecting the goods by the contractual partner at Daniel Wepper's headquarters or by delivery. We are entitled to carry out partial services or partial deliveries.

4.2. Delivery takes place within a reasonable period of time, in any case within 30 days for consumers. However, we are only obliged to provide the service if the contractual partner has fulfilled its obligations that are necessary for the execution, in particular technical preparatory work and preparatory measures.

4.3. The delivery period may be extended if unforeseen circumstances or circumstances independent of the party's will occur, such as force majeure, delays in transport, strikes, official measures, etc. The delivery period is also extended if the contractual partner does not fulfill the obligations required for execution on time.

4.4. When purchasing by mail order, the risk of accidental loss and accidental deterioration of the goods is transferred to the contractual partner when we notify us that they are ready for dispatch and delivery. If the contractual partner is a consumer, the transfer of risk only occurs when the goods are handed over to him or to a third party designated by him who is not the carrier.



Consumer's right of withdrawal
If you are a consumer, you have the right to withdraw from this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the goods

Consequences of cancellation

If you cancel this contract, you agree to pay a cancellation fee of 18% of the bid price! If the delivery has already been made and the item has not yet been used, there is a right of cancellation in principle! The delivery and shipping costs will also be charged here! We must refund immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract if we received your payment before the cancellation. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund. We can refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us immediately and in any event no later than fourteen days from the date on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period.

You will bear the direct cost of returning the goods. The costs are estimated at a maximum of approximately EUR 0-10,000. You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods which is not necessary to check their quality, properties and functioning.
